“Rapid shortage of judges” leading to unheard cases: High Court

The Delhi High Court has highlighted the “rapid shortage of judges” in relation to population and litigation quantum, due to which many cases have been unheard of.

The High Court said that due to overflowing the dock, it was unable to decide the appeal within the appropriate time and when some cases remain unheard, it is “extremely painful” for the judge.

The court comment was a cheating and a petition hearing by a convict in the case, which allowed him to travel abroad to participate in a club assembly of Rotary Club in Almaty, Kazakhstan and Georgia for their social relations and business development.

Justice Kathpalia said, “In my view, since the court overflows, the court is unable to decide the appeals within a appropriate period, even to some extent the right to holiday trips should not be rejected.”

The court allowed the man to travel abroad from May 1 to May 11, such as presented a personal bond of Rs 5 lakh with a certainty of the same amount.

It states that events such as the club assembly of rotarian are more in the form of general gate-tutors where social and commercial relations are developed.

“Due to the rapid decrease of judges compared to the general population and litigation quantum, long -term, the list of regular cases does not reach till the end of the day of hearing.

“, Rather, beyond 05:00 pm, when the courts grow for the day, some cases remain unheard of, which is extremely painful for the judge. In such an uncertain environment, depriving the applicant/ appellant of free movement, even if it may not be appropriate to enjoy the holiday visits,” said the Justice Katpalia.

The court mentioned that the man’s appeal challenging his sentence in cheating and forgery case was filed in the High Court in 2019 and accepted by the previous judge, which was heard in his turn as a regular case.

The person’s lawyer said that he was allowed to go abroad earlier and due to being 67 years old, there was no scope for his escape from justice.

The CBI counsel had told the court on an earlier occasion, the person was denied permission to travel abroad as it was a holiday journey and said that if he was allowed to leave the country, he did not return.

Permission for the man’s petition, the High Court said that the court should be conscious of ensuring the return of the applicant to face the pending legal proceedings that can be done by implementing the appropriate terms on it.
