The amendment reduced the religious and cultural autonomy of Muslims, AAP MLA Amanatullah Khan in his petition that the government’s intervention reduces the rights of minorities to manage its religious and charitable institutions.
However, the government has said that the law will benefit Muslim women and ensure transparency in managing Waqf properties.
Challenging the constitutional validity of the WAQF Amendment Bill, Mr. Khan said that the law violates many fundamental rights of citizens, including freedom of equality, management of religious affairs and management of minorities.
The bill curbs the religious and cultural autonomy of Muslims, enables arbitrary executive intervention, and, according to its petition, reduces the rights of minorities to manage its religious and charitable institutions.
His petition follows similar challenges by two opposition MPs, Mohammad Jabde of Congress and Asaduddin Owasi.
Mr. Jod, who was part of the Joint Parliamentary Committee on the Waqf Bill, said that the law discriminates against Muslims by implementing sanctions that are not present in the rule of other religious institutions.
Major concerns against the law are a provision to include non-Muslim members in Waqf Council and State Boards. This is not a case with the Hindu Services Board or Jain Services Board and is a serious violation of the Constitution, Mr. Owissi argued.
