Delhi High Court ordered a CBI inquiry into a forced recovery racket in Tihar Jail

The Delhi High Court on Friday ordered a preliminary inquiry on the allegations of a forced recovery racket inside the Tihar Jail, involving its officials.

A bench of Chief Justice DK Upadhyay and Justice Tushar Rao Gedela directed the Principal Secretary, Home Department, Delhi Government to investigate a fact and investigate and find out the officials responsible for administrative and supervisory laps in Tihar.

“The petition has highlighted some irregularities, illegalities, misconducts and misconduct not only on the part of the jail authorities, but also the prisoners, the allegations are as serious as the recovering racket was going on in the jail premises for the purchase of some facilities with the jail authorities,” the court said.

The bench stated that the Inspection Judge, a report of the Central Jail 8 and the Semi Open Jail, tendered it in a seal cover after “completely” interrogated, revealed the “very disturbing facts”, indicating criminal activities and irregularities in the functioning of Tihar Jail, indicating criminal activities and irregularities.

The court ordered, “The report (to inspect the judge) involved allegations of criminal activities to conduct a thorough investigation in the case, we consider it appropriate for the CBI need to conduct a preliminary inquiry into the case.”

The bench said, “We also consider appropriate for the Principal Secretary, Home, GNCTD, who are conducting an administrative inquiry to conduct an administrative inquiry to detect such administrative omissions and officers/officials responsible for the accident in jail.” The jails of Director General (Director General) Delhi should increase all cooperation for the Principal Secretary.

The court asked the CBI and Principal Secretary to submit their report before the next hearing on August 11.

The court was hearing a petition filed by a former prisoner which was accused of extortion and pointed to the safety and security of the prisoners inside Tihar.

The court stated that the report of the Inspection Judge was based on several materials, including some call data records regarding calls between the misuse of the official landline of the jail and some call data records between persons outside the jail, “the report also suspected the petitioner’s conduct.

The preliminary inquiry of the CBI will proceed to the main inspection judge’s report and the petitioner along with the jail authorities presented their evidence to the agency.

Once the documents and materials were obtained by the CBI from the court, the petitioner and the jail authorities, the agency was ordered to start its investigation and prepare a report.

“Principal Secretary, Home, GNCTD is also directed to conduct administrative/fact-and-poke on the report. In the said inquiry, the DG Jail will expand all cooperation for him. The investigation will reflect on various administrative laps/supervisory laps and clearly indicate officials responsible for such laps.”
