Accepting the controversy of a nine-year-old boy, he maintains ‘permanent disability’ after being hit by a state-driven bus in 2019, claiming a motor accident that the tribunal in Latur, Maharashtra has directed the MSRTC and the driver to give him a compensation of about Rs 37 lakh.
On May 28, 2019, a three-year-old boy was crossing the road with his sister with a Maharashtra State Road Transport Corporation bus in Pimpra-Lamb village.
In an argument filed before the MACT in January 2023, the minor claimed that the bus was operated in a “grain and negligence” manner, and demanded compensation from the objectionable driver under the MSRTC as well as the Motor Vehicles Act.
He said that due to the accident, he lost all the sensation in his right hand, thus faced 100 percent permanent disability.
“The boy was three years old at the time …. He belonged to an upper-middle class family. He must have gone to a good school and had educated in future and earned a beautiful salary or income. Due to the accident, he is unable to do any work with his right hand,” said Dalil said, demanded compensation of more than Rs 35 lakh.
Along with the MSRTC, the bus driver refused to the tribunal that the accident occurred due to driving.
Principal District Judge and Mact (Latur) member VV Patil, earlier this month, cited a charge-sheet against the police investigation and the driver in an order earlier this month, which was as “enough evidence to work on his share and carelessly”.
The tribunal said that the driver has just started without realizing that a child was in front of the vehicle.
On inspecting the boy, the tribunal noticed that the right hand was completely damaged.
“Thus, I assume that the applicant has maintained permanent disability. However, the doctor (examined by the Tribunal) assessed the disability at 80.25 percent, as the applicant would be unable to do any work in the future for his livelihood, I assessed his permanent disability as 100 percent,” the MACT member said.
The tribunal ruled that the boy was entitled to a total compensation of Rs 36,37,200 and was interested in 7.5 percent per year from the date of filing the claim petition. The MSRTC and the driver were jointly directed to pay the amount.
