A 43-year-old man has served a legal notice in Bengaluru, seeking compensation of Rs 50 lakh from Bruhat Bengaluru Metropolitan Palik (BBMP) for “physical pain and emotional trauma” due to alleged broken and non-modern roads in the city.
Dhiva Kiran, a resident of Richmond Town, in his notice, said that despite being a tax-paying citizen, he has faced frequent physical difficulties and mental pain due to the alleged failure of the civil body to maintain infrastructure.
He claimed that due to severe neck and back pain, five trips were made in four emergency trips in orthopedics and hospitals. He said, “Due to coming on these trusted streets,” he was medically associated with jerk and trauma “.
There was no immediate response to BBMP on notice.
Broken and waterfall roads in different parts of the city often have a bad dream for most people of the city on roads. Unusually huge night rains on Sunday brought the IT capital to their knees on Monday, as people were seen through water and their houses were extracted with the help of inflatable boats.
“My customers say that they were forced to visit 5 orthopedic experts due to acute pain. They had 4 emergency visits to the hospital in St. Philomena, undergoing injections and procedures to overcome acute pain. Also, many drugs and painkillers have been asked to manage conditions,”
He said, “He has also experienced the episode of crying in pain, loss of sleep, anxiety and crying in mental crisis, all of which have deeply impressed his good and daily functioning,” he said.
Mr. Kiran also said that he is unable to travel on auto or two-wheelers, as unequal and damaged roads have severely spoiled his spinal and neck position. “Even the cab ride is difficult, although it is mildly more tolerant than an auto or bike. It severely limits their dynamics and freedom, which affects both their personal and professional commitments,” said his lawyer.
This is due to the BBMP’s “gross negligence and failure to discharge his public duty” that the man is facing “physical pain, emotional trauma and financial burden”, the notice said.
It states that Mr. Kiran has demanded compensation of Rs 50 lakh for emotional and physical crisis within 15 days and cost of travel for medical consultation. Failure to do so will attract legal action, it said.
Mr. Kiran demanded Rs 10,000 as allegations for legal notice issued to BBMP.
Talking to NDTV, Mr. Kiran said: “Bangalore roads are a mess. Even the smallest pits can create a lot of crisis.”
He said that he had flagged the issues to the authorities in the past but in vain. “It is very sad that the city does not care about a good infrastructure. That is why I have sent a notice to the authorities. If needed, I will file a PIL (public interest litigation). I should suffer? I should suffer? At least the state can provide us with good roads,” he said.
