New Delhi:
The honor for the judiciary is paramount and all the columns of democracy are working together for a developed India, the top government sources have said. The statement appears to be a balance act after the Vice President Jagdeep Dhikar and a part of BJP leaders targeted the Supreme Court and the top judges paid attention to.
The government said, “The honor for the judiciary is paramount. All pillars of democracy are working together for a developed India. The judiciary and legislature are two sides of the same coin.”
Shortly after the explanation, the Supreme Court turned some provisions in the controversial Waqf Amendment Act, which has given rise to protests in many parts of the country. After the red flag, the Center has stopped some provisions in the new law.
The Center, sources said, through the appropriate legal process, they will address all the pending Waqf petitions in the Supreme Court. The source said, “Everyone has the right to knock the doors of the Supreme Court. India’s Union will present its side in the Supreme Court.”
The Center’s comment in relation to the judiciary closed on a heels of strong words against the top court of Vice President Jagdeep Dhankhar. The Speaker of the Rajya Sabha also targeted the apex court at his Tamil Nadu’s verdict, which for the second time, set a time limit for the President and the Governors to clean the bills passed by the Legislature. We cannot have a situation where you direct the President of India and on what basis … Article 142 (has become an nuclear missile against democratic forces, which is available for the judiciary 24 x 7, “he said.
Doubling, Mr. Dheer today insisted that Parliament is “supreme” and elected representatives are the last owners of constitutional materials.
In its Tamil Nadu judgment, the apex court also stated that only courts have privileges to provide recommendations about the constitutionality of only one bill and the executive should use restraint in such cases.
Following the historic decision, the Supreme Court faced criticism from a part of BJP leaders. BJP MP Nishikant Dubey provoked a line when he said that if the Supreme Court takes all the decisions, Parliament should be closed. “The Supreme Court is crossing its boundaries … When the issue of Ram temple, Krishna Janmabhumi, or Gyanvapi arises, you (Supreme Court) say, ‘Show us paper’. But for mosques built after the Mughals arrive, you are saying how you will show the papers? Mr. Dubey asked how the Supreme Court can set a time limit for the President and the governors to clean the bills. BJP leader Dinesh Sharma said that no one can “challenge” to the President, as the President is “supreme”.
The BJP leadership removed itself from the comments of its leaders. “The Bharatiya Janata Party has nothing to do with the statements made by BJP MPs Nishikant Dubey and Dinesh Sharma on the country’s judiciary and Chief Justice. These are his personal statements, but BJP neither agree with such statements nor supports such statements.
However, the opposition has accused the ruling party of threatening the judiciary and trying to weaken it.
Senior judges in the Supreme Court have made it clear that they have noticed the comment. Justice Bra Gavai, who took over as the Chief Justice of India next month, mentioned twice yesterday that the apex court was accused of encroaching the executive’s domain. And today, Justice Surya Kant, the third most senior judge of the Supreme Court, said that the institution of the judiciary attacks every day and they are “not worried”.
Justice Surya Kant’s remarks came when he contested the court case related to a newspaper report from Karnataka. The lawyer, while arguing on the matter, pointed out the public criticism of the judiciary and urged the Supreme Court to take notice of contempt allegations. In response, Justice Surya Kant indicated that he was “not worried about the institution …”.
