The Allahabad High Court has provided police protection to an interfaith live-in couple, while it hears a petition alleging threats from his mother’s former in-laws by their minor daughter. The court also cited the Supreme Court cases that the main age persons could “live together, even if they have not married”.
A division bench by Justice Shekhar B Sarf and Justice Vipin Chandra Dixit noticed that the child’s biological parents are from various religions and have been living together since 2018.
The court further saw that the parents expressed concern over the “threats from the respondents”.
The parents also claimed that the police had refused to register the complaints despite several requests to do so, and when they had contacted the police station in Sambhal, UP, they were ‘insulted’.
“In the light of the same, the Superintendent of Police (SAIR) is directed to ensure that the first information report should be filed … if the parents contact the police station.”
“The Superintendent of Police (Sambhal) is also directed to see if the child and the parents should be provided any protection according to the law …”
Preliminary reports suggest that the mother started living with the child’s biological father after her husband’s death. He then received threats from his former in -laws.
